Prohibited & restricted items

OfferMe reserves the right to remove any prohibited and restricted items including those not on this list if they are considered inappropriate, illegal or are in breach of our User Agreement.

You are responsible in making sure that you are legally allowed to buy or sell an item.

The following list is not intended to be an exhaustive statement of prohibited and restricted items.

  • Alcohol

    You must have a licence to sell wine and other alcohol on OfferMe and display your licence number in the Offer. Make sure you know the laws of trading alcohol in all states you may trade in.

  • Animals, Animal Products, Organs or any Body Parts

    You must not offer any pets animal/wildlife products or internal organs including human parts & remains.

  • Artefacts and Heritage Items

    You must not offer any artefacts or heritage items on OfferMe.

  • Adult Related Items

    Images or content which is adult or sexual related or inappropriate for people under 18 is not allowed. You must not offer items that are considered to be indecent by the authorities or illegal to sell in Australia.

  • Copyright-infringing, Replica and Counterfeit Items

    You must not offer items or include content which breaches any copyright or other intellectual property rights. Unauthorized replicas and counterfeits are not allowed to be offered on OfferMe. If you are unsure if an item is genuine, do not offer it on OfferMe. (Any product that bears a trade mark not owned by the manufacturer or used under the trade mark owner's licence, must not be offered.)

  • Downloadable Media

    Items that can be downloaded (digital) can only be offered by sellers that own the intellectual property or are authorised to distribute the intellectual property by the intellectual property owner.

  • Drugs

    You must not offer any controlled prescription drugs both herbal or chemical on OfferMe.

  • Food

    Food items offered on OfferMe must be sealed, have labels that meet Australian laws and show expiry dates.

  • Fireworks

    You must not offer any fireworks on OfferMe.

  • Lock Picking Devices

    You must not offer any lock picking or lock smithing device including key cutters.

  • Noxious Weeds

    Before offering plants or seeds ensure you are aware and up-to-date with the current legislation for noxious weeds. Plants or seeds that are officially listed as a noxious weed must not be offered on OfferMe.

  • OEM Software

    You must not offer Original Equipment Manufacturer software (OEM) on OfferMe unless offered with the specified accompanying hardware.

  • Police and Emergency Services Related Items

    You must not offer official Police or Emergency services equipment related items on OfferMe regardless of origin (other countries). For example: badges, uniforms and any official or recent issue equipment. Any Police or Emergency items offered must be obsolete and in no way resemble official or recent issue. You must state this fact in your item description.

  • Postage Stamps

    Used and "washed" Australia Post postage stamps offered for sale, with the obvious intention that they will be re-used must not be offered on OfferMe. Any offer to sell "uncancelled stamps" must be accompanied by a clear warning which draws viewers attention to the provisions of section 471.5 of the Commonwealth Criminal Code.

  • Radio-communications Devices

    Mobile telephone jammers, GPS (Global Positioning System) jammers and mobile telephone boosters must not be offered on OfferMe. Jammers in particular are prohibited devices and cannot be sold or used within Australia. Any Radio communicating devices, including boosters must also comply with any applicable Australian standards in line with the Radio-communications Act 1992. The holder / operator of such items may also need to be licensed / qualified prior to using certain frequency bands. Refer to the Australian Communications and Media Authority (ACMA) website for further details.

  • Real Estate

    Real estate cannot be offered on OfferMe due to the complicated laws governed by the sale of real estate.

  • Software That Accesses OfferMe

    You must not offer software which directly or indirectly accesses OfferMe's web site and database without approval by OfferMe.

  • Stolen Goods

    Goods to which you are not the legal owner or which you are not otherwise legally entitled to sell must not be offered on OfferMe.

  • Tickets Over Face Value

    OfferMe does not allow tickets to be re-sold beyond their face value (referred to as ticket scalping). The amount on Offer needs to be less than or equal to the face value of the ticket or voucher.

  • Therapeutic Goods

    Therapeutic goods, unless exempt, must be entered as either 'registered' or 'listed' goods when being offered on OfferMe. All medicines must display an"AUST L" number on the label. All registered medicines must display an "AUST R" number on the label as required by the Therapeutic Goods Administration (TGA).

  • Tobacco

    You must not offer tobacco which includes cigarettes, cigars, and smokeless tobacco on OfferMe. Tobacco related items may be allowed for sale. The sale of bongs used for smoking cannabis and other drug-taking paraphernalia is illegal and may not be offered on OfferMe.

  • Used Clothing

    Used clothing cannot be offered excluding some special clothing. Special clothing such as t-shirt used by some sports-person etc that has been used may be offered, however, the garment must be cleaned before sending. Used underwear and swimwear (including children's) and cloth nappies must not be offered on OfferMe.

  • Used Cosmetics

    Used cosmetics must not be offered on OfferMe.

  • Weapons, Knives and Firearms

    Weapons must not be offered on OfferMe with the exception of some Knives/Swords.

    Knives/Swords must comply with current Australian laws. Sellers must ensure State Legislation is adhered to, prior to offering such items. Sellers may be required to include specific clauses within their descriptions, outlining any restrictions in place by certain states, so that members residing in those states do not purchase the items.     Firearms (including ammunition) with the exception of collectable/antique items (which have been rendered inoperable) cannot be offered on OfferMe.
